son in 1977 and is engaged in insolvency
including liquidations and receiverships,
arrangements for companies in difficulties, real
estate, planning and building law, supporting real
estate transactions including urban renewal, TAMA
38, commercial litigation including commercial and
business law, class actions, tenders and contracts.
The firm is ranked by Dun & Bradstreet and BDI as
one of the leading firms in insolvency, and real es-
tate – planning and building.
Insolvency Proceedings
The firm specializes in insolvency proceedings in-
cluding stays-of-proceedings, creditors’ arrange-
ments,receiverships,liquidationsandbankruptcies.
Advs. Bergerson, Elkin and Dolev serve as trustees,
receivers, liquidators and special managers through
court appointments as requested by creditors, com-
panies and banks. The firm and Adv. Bergerson’s
expertise in insolvency proceedings allows handling
complex buy and sell deals for companies in re-
covery proceedings, liquidation and receivership,
especially complex real estate deals, such as the
Dizengoff Frishman residential project purchased
by a company in insolvency proceedings.
Select insolvency proceedings cases:
N.I.L.I. Real Estate – After legal proceedings in
the courts Adv. Bergerson succeeded as receiver
to sell real estate for NIS 235 million.
Sasson Levy Ltd. – Receivership and liquidation
proceedings for a company owning Jerusalem land
sold for NIS 173 million by Adv. Bergerson, the liq-
uidators and receiver.
Mifal Hamakor Ltd. – Operates one of Israel’s larg-
est print houses and was in financial difficulties
with debts of NIS 50 million. Adv. Amir Dolev was
appointed receiver and operated the company for 7
months, formulating creditors’ arrangements, and
the company returned to normal operations.
Marko Shoes Ltd. – operated 23 shoe stores and
was in severe financial crisis with debts of over NIS
30 million. Adv. Dolev was appointed company
trustee during the stay-of-proceedings, operating
the chain and after several months of streamlining
measures, formulated creditor’s arrangements. The
chain returned to its owners.
Cost365 Ltd. (in liquidation) – a grocery store chain
established by Hamashbir Lezarchan and was sold
to investors. In 2015, Cost was debts of tens of
millions of shekels. The District Court appointed
Adv. Bergerson and Adv. Insel as the company’s
liquidators and the liquidators sold the company’s
branches for millions of shekels.
Mordechai Binyamin &Sons Ltd. – A veteran infra-
structures companywhich undertookdevelopment
and infrastructure workworth hundreds of millions
of shekels annually. The company had debts of NIS
300million.The firm representedBankLeumi which
was owed tens of millions of shekels.
Ezra Sasson & Sons Building & Development Co.
Ltd. – Built residential projects worth hundreds of
millions of shekels, collapsed and applied through
the firm for a stay-of-proceeding and creditors’ ar-
rangements, allowing projects to be implemented
and forming creditors’ arrangements.
Alaska Food Ltd. – Imports andmarkets food prod-
uctsmainly in cans, that collapsedwith debts of over
NIS 20 million. Receiver Adv. Dolev worked to sell
the company’s operations and collected debts from
customersworthmillions of shekels and successful-
ly repaid most of the debt promised to creditors.
Burger Ranch Center (1983) Ltd. – Operated a
chain of 50 fast food outlets throughout Israel with
1,200 employees but slipped into difficulties and
was no longer a going concern. Adv. Bergerson
was appointed company liquidator with another
liquidator and receiver. The officers appointed
operated the chain for several months until sale
proceedings were completed.
Real Estate, Planning & Building and Urban
Renewal
The firm’s Real Estate Department renders clients
overall and comprehensive legal services fromproj-
ect development, locating land, financing, building
andmarketingprojects. Comprehensive consultancy
in all required areas for implementing and complet-
ing real estate deals include planning and building,
urban renewal, evacuation and reconstruction (Pinui
Binui) and TAMA 38.
Legal representation in real estate matters
Representation before local committees, ap-
peal committees, district committees, admin-
istrative courts, proceedings in the Israel Land
Administration.
Representing Companies, Real Estate Appeals–
Supporting property companies and individuals
in buying, developing and improving real estate in
large cities and throughout Israel. Projects recently
supported by the firm include: Developing and
supporting the Dizengoff Frishman project, Tel Aviv
and projects in Holon and Florentin; developing
and improving real estate throughout Israel.
Urban renewal deals, clear and build, TAMA 38 –
Supporting developers, tenants, companies and
landowners in urban renewal projects.
Financing construction –Consultancy to banks and
developers on financing construction, including
urban renewal deals and Pinui Binui projects and
everything related to them.
Infrastructures – Legal consultancy and support
for Israel’s largest infrastructure companies on
infrastructure projects such as highways, infra-
structure tenders and financing.
Routine support and litigation in tenders
law, administrative petitions and commercial
transactions
In the tenders sector, the firm has supported ten-
ders committees of large organizations such as
Netivei Israel National Roads Co. Ltd. and Clalit
Health Services. Legal support includes drafting
tenders, providing consult to tenders committees
and professional bodies, handling procurement
tenders, infrastructures, real estate, etc. The firm
has special expertise and rich experience in rep-
resentation during legal proceedings for tenders,
defending tenders committee decisions, adminis-
trative petitions on tenders, administrative suits,
etc. The firmalso supports deals in various sectors
including drafting contracts, and due diligence.
Class Action Suits
The firm has represented dozens of defendants in
class action suits, handling 40-50 suits annually.
Clients include Neto Melinda, Shkedia, Bikorei
