M

oshe Kaplansky Law Office was estab-

lished in 1974 and specializes in liti-

gation and legal representation in the

areas of torts and all types of insurance including

professional liability, elementary insurance, body

damages, computer offenses, bank insurances,

financial damages and losses against insurers in

Israel and abroad. As well as contractual, financial

and tort lawsuits in all insurance areas, commercial

civil law, commercial criminal law, class action and

derivative lawsuits.

The firm employs 20 lawyers in three divisions:

body, property and commercial. The firm’s working

method consists of establishing a team for each

case file, carrying out legal analysis, personal

relationships with the clients, relying on creativ-

ity, initiative, innovation and implementation of

international laws.

The firm is owned by Mr. Moshe Kaplansky, Advo-

cate and Notary, who manages it together with his

son Dr. Kobi Kaplansky, Advocate. The firm is char-

acterized by its family nature and relies on many

years of experience and seniority, employing the

second and third generation of the family.

The firm represents private clients versus all insur-

ance corporations, financial institutions, banks,

High-Tech, electronic and military industries in

Israel and abroad, public and private companies,

aerial, maritime and ground accident injuries suing

the insurance and/or torts. The firm’s clients are

represented in legal procedures of class action,

derivative and collective lawsuits.

Precedents

For over 40 years the firmparticipates in the setting

of leading precedents in the areas of insurance and

torts, life and elementary insurance, professional li-

ability, senior officers in corporations andmaritime

and aerial insurance.

In the frameworkof the Road AccidentVictims Com-

pensation Law, the firm represented claimants at

Neviot Disaster whose winning was the basis for

leading innovative rules and caused a statutory

change in the area.

• Following are some of the legal precedents set by

the firm, in the past and the present, as a leader in

the field, such as Legal accompaniment ofShayetet

13, the combatants of the Navy Commando Unit,

in the “Kishon River Trial”.

• Civil Appeal file no. 3128/94 – Ramat Chen

Synagogue Cooperative Society against Sahar In-

surance Ltd.

Policy interpretation and terms “use of force” com-

pared to “use of force and violence”.

• Adoption of “Reasonable Expectation Doctrine”

of the insurer, by which if the policy does not pro-

vide an unequivocal solution to a situation, the

insurance policy shall be interpreted according to

the insurer’s reasonable expectation.

• Civil Appeal 6507/11 at the Supreme Court,

Loockey Construction Plants Ltd., G.D. Ait Services

Ltd. et al. The contractor’s liability in construction

flaws and personal responsibility independently

of the company’s liability.

• Civil Appeal 753/75 Yocheved, Alon, Erez, Ehud

and Amir Balaga versus the estate of the late Na-

than Taft – vehicle stepping on a car considered as

“road traffic”.

• Civil Appeal 236/81 Zilpa Lassri & al. against

Zion Insurance Ltd. – Expanding the interpretation

of the term “road traffic” and its implementation

even on a case in which the detrimental result

was within the risk caused by the behavior of the

damaging party, according to the “human factor”

test. TheSupreme Court accepted the appeal of the

Lassri family and ruled that the fire that caused the

death and serious injuries of vacationers on the

beach, as a result of a gas container explosion is

a road accident, entitling to compensation by the

Road Accident Victims Compensation Law 1975.

• The verdict recognized for the first time in Israel

the right of a damaged party to be operated at a

hospital abroad, after proving that the success

probability of such operations is higher than in

Israel. This rule was one of the factors that resulted

in amendments to the Road Accident Victims Com-

pensation Law in Israel.

Moshe Kaplansky, Advocate & Notary

Born onMay 1, 1937, married with 3 children and

9 grandchildren and great grandchildren.

At the beginning of his career, Adv. Kaplansky

managed Midgal Insurance Ltd.’s Claims Depart-

ment, being responsible for the management of

lawsuits in all insurance areas.

1969: qualified as a member of the Israel Bar

Association.

1970-1975: acted as Vice President of the Israel

Assessors Union.

1971-1976: acted as a lecturer at the Israeli Insti-

tution for Insurance.

1974-1992: served as defense counselor at the

IDF’s General Staff (Res.).

1982-1992: acted as Head of the National Disci-

plinary Court of the Israel Bar Association.

1989– 2003: acted as a lecturer at the Israel Man-

agement Center.

In 2001 theMinister of Justice, Meir Shitrit, offered

him to be appointed as Supreme Court judge.

Since 1996, Adv. Kaplansky acts as Head of Ethics

Court of the Press Council.

Since 2010 the firm is ranked at Dun’s 100 as

one of the most outstanding law firms in Israel

in the areas of torts and insurance and one of

the “100managers” leading social liability in the

framework of “Shiur Aher” Association.

2004-2003: Bachelor’s degree in law - Bar-Ilan

2010: Doctor (PhD) Anglia ruskin university.

The office has 45 employees including Dr. Kobi

Kaplansky, Adv., member of the Israel Bar Associa-

tion since 1994, Adv. Gali Kaplansky, Adv. ChenGi-

lad and a total of 20 salaried lawyers and interns,

pre-interns and administrative secretarial team.

The firm operates in a 7 stories building, being

fully occupied by the firm’s staff, completely com-

puterized, equipped and compartmentalized.
